Fair Shake Environmental Legal Services will be holding two free legal clinics in partnership with Clean Water Action and Women for a Healthy Environment to provide critical information and one-on-one time with an attorney for some 5600 residents who may unknowingly be involved in a class-action lawsuit against U.S. Steel’s Clairton Coke Works.
Fair Shake is not part of this lawsuit. We are providing any class members with the chance to speak to our attorneys with any questions they may have before they make their decisions.

On December 4th, 2019, a proposed settlement agreement was reached between representatives for U.S. Steel and a group of Clairton residents who brought a class-action lawsuit claiming U.S. Steel's Clairton Coke Works for violating their right to enjoy their property because the air smelled bad.
This proposed settlement agreement that will automatically include a “class” of 5600 residents from three municipalities around the facility and it will automatically assume that these class members want to opt into an agreement that forfeits their right to sue U.S. Steel for nuisance and loss of property value caused by air pollution that occurred before Dec. 24th, 2018. It will not automatically assume they want to receive a payment for this agreement.
Class members may have already received a white envelope labeled “Court-ordered settlement notice” from “Settlement notice administrator” with a Chicago address. These residents have 30 days to opt-out of this agreement and 45 days to decide whether they want payment if they opt-in or their time lapses to opt-out.
